In the counter affidavit filed in W.P.No.18987 of 2011, the Assistant City Planner, Circle VII, GHMC, would state that a showcause notice was issued to Sri K. Murali Mohan on 08.07.2011, under Section 452 of the Hyderabad Municipal Corporation Act, 1955 (for short, ‘the Act’), and was served on the Supervisor, (who was supervising the unauthorised construction in the open land in question), as the persons raising unauthorised constructions were not available at the site; thereafter he had requested the Station House Officer, Asifnagar Police Station, to take necessary action, under Section 461 (4) of the Greater Hyderabad Municipal Corporation Act, against the Special Power of Attorney Holder of Sri K. Murali Mohan i.e., Mohd. Fiaz Khan Khalildi and others who were constructing a compound wall, (in Survey Nos.294/1 to 12 and 297/1/1, 2/1, 3/1, 298/1 and 299/1 of Gudimalkapur Village), unauthorizedly which was causing damage to the existing water tank; since no explanation was submitted to the show-cause notice issued on 08.07.2011, a final notice, under Section 636 of the Act, was issued on 30.08.2011 for removal of the unauthorised constructions; and, as the persons raising unauthorised constructions were not available at the site to receive the notice, a copy thereof was affixed on the gate of the unauthorised structures as required under Section 631 of the Act, and photographs were taken to that effect. It is asserted, on behalf of the GHMC, that the official respondents would execute the final notice to remove the unauthorised constructions, and stop further construction, if they were given protection by the police authorities, more so as the area, where the illegal constructions were raised, is a sensitive area, and the demolition squad was being threatened by Mohd. Fiaz Khan Khalildi and others by gathering a large number of people at the site in question.
