The petitioners have claimed for grant of pension under Swatantra Sainik Samman Pension, 1980 as they had served during the freedom movement for liberation of Hyderabad State in the years 1947-

Counter has been filed on behalf of the Government of India, wherein it has been averred that on receipt of the re-verification reports from the Government of Andhra Pradesh, the cases of the petitioners except at Sl.No.3 have been duly examined. The cases of the petitioners at Sl.Nos.1, 2, 4, 5, 6, 7, 9, 10, 12, 13 and 14 were referred back to the State Government for rectification of deficiencies as per policy guidelines dated 10.09.2009. The verification reports of the State Government in respect of petitioner at Sl.No.3 have not been received from the State Government. The verification reports at Sl.Nos.8 and 11 are under process in the Ministry. A reminder to the State Government has been issued vide letter dated 15.12.2011 to expedite the verification of deficiencies pointed out by the Ministry and resubmit the case for further necessary action.

Learned counsel for the State submits that the letters said to have been issued by the Central Government were not received by the State Government, but, however, necessary information would be sent to the Central Government as expeditiously as possible.

After hearing the learned counsel for the parties, this Writ Petition is disposed of, with a direction to the State Government to rectify the deficiencies with regard to petitioners at Sl.Nos.1, 2, 4, 5, 6, 7, 9, 10, 12, 13 and 14, and also send the verification report with regard to petitioner at Sl.No.3, within a period of four weeks from the date of receipt of a certified copy of this order, and on receipt of such reports from the State Government, the Central Government shall take a final decision with regard to petitioners at Sl.Nos.1, 2, 3, 4, 5, 6, 7, 9, 10, 12, 13 and 14, within a period of two months thereafter. All the petitioners be informed the decision being taken by the Central Government. No order as to costs.
