ORDER:
The petitioner has filed the present contempt case, wherein it has been averred that the respondent herein has disobeyed the orders dated 23.02.2011 passed by this Court in W.P.No.4321/2011, vide which, this Court directed the respondent herein to consider the
application filed by the petitioner dated 13.04.2010 in terms of G.O.Ms.No.743, dated 30.04.1963, within a period of three months from the date of receipt of a certified copy of the order.
Counter has been filed on behalf of the respondent, wherein it has been averred that the application of the petitioner has been got enquired into and on enquiry, it has come to the notice that the lands applied for by the petitioner are classified in the revenue records as Sy.No.279/30 – Reserve forest and Sy.No.590/4 – Vagu (stream).
It is stated that in view of the fact that the lands applied for by the petitioner are classified as reserve forest and Vagu (stream), therefore, the application put in by the petitioner for assignment of the aforementioned lands cannot be assigned under the Rules in force.
In view of the fact that the application of the petitioner has been duly considered and the request of the petitioner for assigning the aforementioned lands is rejected as they are reserve forest and Vagu (stream) respectively, therefore, there is no merit in the contempt case, and no contempt has been made out against the respondent.
The Contempt Case is accordingly dismissed.
