The Writ Petition is preferred by the General Manager, Singareni Collieries Company Limited, Mandamarri area, Adilabad District, challenging the legality and validity of the Award dated 03.04.2003 passed in I.D.No. 86 of 2002 filed by the 2nd respondent workman on the file of the Industrial Tribunal-cum-Labour Court, Godavarikhani, Karimnagar District. The said I.D. has been raised by the 2nd respondent workman under Section 2-A(2) of the Industrial Disputes Act, 1957, challenging his dismissal from the service by the Singareni Collieries Company Limited, due to unauthorized absence continuously, which amounted to misconduct. The charge has clearly listed out as to how each month the 2nd respondent workman had stayed away from duty unauthorizedly and consequently, his services came to be terminated for the proven misconduct. The Industrial Tribunal-cum-Labour Court has rendered an Award running to one and half page.
