According to the petitioner, the said land of Ac.8-41 gts in Sy.No.265/54/2 and 265/64/2 situate at Akinepalli village of Khammam District originally belonged to his father Akula Venkaiah and subsequently fell to the share of the petitioner in the family partition and that the petitioner’s father has been in possession and enjoyment of the same by virtue of a registered sale deed dated 06.06.1970 and ever since the partition, the petitioner is in possession and enjoyment of the said land and R.O.R pass book and title deeds were also issued in his favour. While so, the 2nd respondent Special Deputy Tahasildar in itia te d suo motu proceedings in LTR case No.134/2010/DMPT in respect of the subject land and passed order of ejection of the petitioner on 26.08.2010. It is stated that the petitioner has preferred an appeal before the 1st respondent on 13.01.2011 and also filed an application for stay of the order of eviction. The grievance of the petitioner is that neither the appeal nor the stay application is taken up for consideration by the 1st respondent and no orders have been passed so far but in the meanwhile the 2nd respondent is taking steps to execute the order of eviction and dispossess the petitioner from the said land.
