The petitioners have prayed that a direction be issued to the respondents to implement 15% reservation target under the Scheme framed in G.O.Ms.No.2 Minorities Welfare V&C Department, dated 08-01-2007.

It has been averred that the respondents are not allotting houses to the petitioners/houseless poor people under 15% quota in constructed houses of 3200 of Yellammabanda Banda and Shamsheerguda, Kukatpally Circle No.14 under J.N.N.U.R.M. Housing Scheme.

Learned counsel for the respondents has placed on record the instructions received by him from the Project Director (H), Hyderabad District. According to which, 3016 houses under JNNURM Scheme were constructed in Yellammabanda village; out of which 506 houses were sanctioned to the minorities and thus, minorities have been allotted 16.77% of the houses, which is more than 15% reservation under the Scheme. It has, thus, been argued by the learned counsel for the respondents that 15% reservation to minorities has been implemented.

Learned counsel for the petitioners submits that the petitioner Nos.2 to 41 belongs to Balanagar and Qutubullapur Mandal which comes in Rangareddy District and the District Collector, Rangareddy be directed to consider the case of the petitioners 2 to 41 for allotment of houses under JNNURM Scheme.

After hearing the learned counsel for the parties, I am of the considered opinion that JNNURM Scheme has been fully implemented as far as Yellammabanda, Shashiguda and Kukatpally are concerned, as the minorities have been sanctioned 16.77% houses which is more than 15% reservation provided.

However, as far as Balanagar and Qutubullapur Mandals falling in

Rangareddy District are concerned, the District Collector, Rangareddy District —5^th respondent is directed to consider the case of the petitioners 2 to 41 in terms of their eligibility. The needful be done within three (3) months from the date of receipt of a certified copy of this order.
