This appeal is directed against the order of a learned Single Judge of this Court dated 11-10-2004 in WPMP No. 24374 of 2004 in the writ petition, whereby interim stay of further proceedings including execution, pursuant to a certificate dated 14-6-2004 issued by the Deputy Registrar of Cooperative Societies, Hyderabad, was granted subject to the condition that the petitioner deposits half of the amount due under the impugned award within four weeks from the date of the order.
It is represented by Sri K. Satyanarayana Murthy, learned counsel for the appellant that during the pendency of the appeal the petitioner has deposited the entire amount due to the respondentBank.
In the light of the submission the challenge in the writ petition itself does not survive for adjudication.
Accordingly with the consent of the learned counsel for the petitioner and Sri S.Ashok Anand Kumar, learned counsel for the 2nd respondent, the writ appeal and consequent on the assertion, Writ petition No. 18535 of 2004, are dismissed as infructuous. No costs.
