WRIT APPEAL No.1326 of 2012
ORDER: (Per the Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose) This writ appeal is directed against an interim order, dated 08.02.2012, passed by the Hon’ble Single Judge in WVMP.No.2395 of 2009 IN WPMP.No.17542 of 2009 in W.P.No.13500 of 2009, wherein His Lordship held that since the interim order was granted in the year 2009 and the vacate stay petition was filed in the said year and could not be taken up, the interim order granted by His Lordship on 10.06.2009 was made absolute and dismissed the vacate petition. However, His Lordship directed the matter to be posted for hearing after one month, since it pertains to the year 2009.
From a perusal of the impugned order, it appears that the learned Single Judge has fixed the hearing of the writ petition itself after one month. In that view of the matter, we do not see any reason to interfere with the said order at this stage. However, we request the learned Single Judge to dispose of the matter at an early date, at His Lordships convenience.
The appeal is accordingly disposed of.
Registry to post the Writ Petition No.13500 of 2009 after two weeks before the appropriate Bench.
