JUDGMENT: (per the Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose)
This writ appeal is filed by the writ petitioner against the order dt.31.7.2012 passed by the Hon’ble Single Judge, in W.P. No.1646 of 2010, in dismissing the writ petition.
At the time of hearing, learned counsel for the appellant – writ petitioner sought permission of the Court to withdraw the writ appeal as well as the writ petition with liberty to the appellant – writ petitioner to approach the appropriate forum.
Learned counsel appearing for respondent Nos.1 to 3 submitted that the respondent – bank does not come within the purview of Section 2(h) of the Right to Information Act, 2005, but since we are not considering the said issue in these matters, the issue can be decided by the authority concerned.
Permission and liberty as sought by learned counsel for the appellant – writ petitioner are granted.
The writ appeal as well as the writ petition are accordingly dismissed as withdrawn. No costs.
