2. This appeal is directed against the order dated 23.08.2004 passed by the Hon’ble single Judge in W.P.No.22925 of 2003.

3. The writ petition was filed by the writ petitioner seeking a Mandamus to

declare the action of the first respondent in putting the writ petitioner’s property bearing No.17-11/5, Plot No.190, Hanumanpet Extension, Malkajgiri, Hyderabad to auction as illegal, arbitrary and against the principles of natural justice.

4. After having heard the submissions made on behalf of the writ petitioner, the Hon’ble single Judge was pleased to record as follows:

‘Having regard to the submissions made on either side and on perusal of the material available on record, it is seen that there is no dispute as to the fact that respondent No.3 has obtained loan from respondents 1 and 2 and that the petitioner has given his property as security for the same. The grievance of the petitioner is that the respondents are proceeding to sell his house property without any notice to him.’

5. It appears that on the offer made by the writ petitioner, His Lordship disposed of the writ petition directing the writ petitioner to file a comprehensive representation before the respondents within a period of two weeks and further directed the respondents to consider the same.

6. In view of the above, we do not find that there is any merit in the appeal.

The writ appeal is dismissed. As a sequel, the miscellaneous applications, if any, shall stand dismissed. In the circumstances, there shall be no order as to costs.
