This petition is filed by the petitioner-wife under Section 24 of the Code of Civil Procedure seeking to transfer O.P.No.336 of 2010, on the file of the Family Court, Ranga Reddy District, at L.B Nagar to the Family Court, Guntur.

According to the petitioner, the respondent-husband filed O.P.No.336 of 2010, on the file of the Family Court, Ranga Reddy District, at L.B. Nagar, seeking divorce. Now she is residing with her parents at Guntur and she is apprehending danger to her life in the hands of the respondent. Furthermore, she filed a criminal case against the respondent under Section 498-A r/w 34 I.P.C and the same was registered as Crime No.106 of 2010 of Tadikonda Police Station. She also filed a maintenance case before the Judicial Magistrate of First Class, Mangalagiri, Guntur District. Hence, she filed the present petition seeking to transfer the said O.P to the Family Court, Guntur.

Heard the learned counsel for the petitioner and perused the record.

In spite of service of notice, the respondent herein does not appear before this Court for raising objection to transfer. Therefore, it is presumed that the respondent is not having any serious objection for transfer of the case as sought for by the petitioner.

Admittedly, the petitioner is residing along with her parents at Guntur. Taking into consideration the facts and circumstances of the case, the nature of the proceedings and convenience of the parties, O.P.No.336 of 2010 is withdrawn from the file of the Family Court, Ranga Reddy District at L.B. Nagar and transferred to the Family Court, Guntur. However, the trial Court is directed to dispense with the appearance of the respondent on all the dates of posting, except on the dates of his examination as a witness in the O.P and the dates on which the learned Judge insists for his appearance.

With the above direction, the Transfer CMP is allowed. Consequently, the Miscellaneous Petitions filed in this Transfer CMP, if any, shall stand closed. There shall be no order as to costs.
