ORDER:

This petition is filed by the petitioner-wife seeking to transfer OP No.1196 of 2011 on the file of the Court of the Family Judge, L.B. Nagar, Rangareddy District to the Court of the Family Judge, Mahabubnagar.

It is the case of the petitioner that she filed DVC in the Court of Judicial First Class Magistrate, Mahabubnagar and as a counter-blast, the respondent-husband filed the above OP and that she has a small kid of six months and she is apprehending danger to both of them in the hands of the respondent-husband and therefore, the present OP may be transferred to the Family Court, Mahabubnagar.

Heard and perused the material available on record.

Admittedly, the petitioner is residing in Mahabubnagar and the DVC case is also pending there. Taking into consideration the facts and circumstances of the case, the nature of the proceedings and convenience of the parties, OP.No.1196 of 2011 on the file of the Court of the Family Judge, Rangareddy District, L.B. Nagar, is transferred to the Court of the Family Judge, Mahabubnagar. However, the trial Court is directed to dispense with the appearance of the respondent on all the dates of posting, except on the dates of his examination as a witness in the OP.

With the above direction, the Transfer CMP is allowed. Consequently, interim stay granted earlier stands vacated and all the TrCMPMPs pending are closed. The Family Court, Mahabubnagar is directed to dispose of the OP within a period of six months from the date of receipt of a copy of this order.
