Kudithipudi Chaya Rama Devi Vs Kudithipudi Chandra Sekhar

This petition is filed seeking to withdraw F.C.O.P.No.1 of 2010 from the file of Family Court, Nellore and to transfer the same to the Court of Judge, Family Court, Guntur.

Heard the learned counsel for the petitioner and learned counsel for respondent and perused the material available on record.

The petitioner herein is the wife of the respondent. The respondent herein is filed F.C.O.P.No.1 of 2010 on the file of Family Court, Nellore under Section IX of the Hindu Marriage Act for restitution of conjugal rights.

Considering the fact that the petitioner herein is the resident of Guntur, F.C.O.P.No.1 of 2010 is withdrawn from the Family Court, Nellore and the same is transferred to the Judge, Family Court, Guntur and the Judge, Family Court, Guntur is directed to dispose of the said F.C.O.P. within a period of six months from the date of receipt of a copy of this order.

With the above direction, the Tr.C.M.P. is disposed of. No costs.

Miscellaneous petitions, if any, filed in this petition shall stand closed.
