This public interest litigation is filed to declare the action of the respondents in not taking action against the persons who illegally and unauthorizedly got mutated their names in the revenue records with regard to the lands assigned to the scheduled caste people in Vencherla Village, Balkonda Mandal, Nizamabad District, in spite of making representations by the petitioner in the matter to the respondents, as illegal and arbitrary, and for consequential directions.

The case of the petitioner in brief is that certain lands in Vencherla Village, Balkonda Mandal, Nizamabad District, were assigned to scheduled caste people in the years 1980 and 1981, but after some time, some other persons got mutated their names in the pattadar pass books and title deeds of the said lands illegally and are in possession of the lands. Though the petitioner made representations to the respondent authorities in the matter, no action has been taken so far. Hence, the writ petition.

Having heard the learned counsel for the parties and having perused the material available on record, we direct respondent No.3 – District Collector, Nizamabad, to consider the representation made by the petitioner in terms of communication dt.16.2.2010 issued by the Chief Commissioner of Land Administration, Andhra Pradesh,

Hyderabad, and take necessary steps in the matter.

With the above direction, the public interest litigation is disposed
