This writ petition is filed under the Public Interest Jurisdiction praying to issue a Writ of Mandamus declaring the action of the respondents in finalizing the Hyderabad Metro Railway Project without taking care to protect the vicinity and skyline around the heritage structure, precincts of Hyderabad city like Assembly, Mozamjahi market and Charminar precincts as illegal and unconstitutional and consequently direct the authorities to see that Metro Rail takes underground route near these important heritage structures, precincts like it was done in Delhi, Bangalore and after declaring that the surroundings of this heritage buildings, precincts cannot be tampered, disturbed by elevated Metro Railway corridor.

Heard learned counsel appearing for the parties. Learned Advocate General appears on behalf of respondents 1 and 4.

This Public Interest Litigation has been filed by the petitioner with an apprehension that no steps will be taken by the authorities to conserve the heritage structures in Hyderabad city by the 4^th respondent-Hyderabad Metro Rail Limited. Our attention has been drawn to a letter addressed by the Chairman, Heritage Conservation Committee, Secunderabad dated 9-122011.

In our opinion, for the greater public interest both the respondents 1 and 4 shall look into the matter considering the technical feasibility and thereafter take necessary steps for preservation of such heritage structures in Hyderabad.

This Public Interest Litigation is disposed of on the above terms.
