JUDGMENT: (Per Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose)
By consent of the learned counsel for the parties, though this matter is not listed today, it is being disposed of.
2. Having heard the learned counsel for the parties, it appears to us that, in this matter, an order has already been passed by a Division Bench of this Court on 18.04.2012.
3. The aforesaid order shall continue in the matter till the writ petition is disposed of by the Hon’ble single Judge. However, we make it clear that the Hon’ble single Judge shall not be influenced by the order dated 18.04.2012 in the matter by the Division Bench. We only request the Hon’ble single Judge that his Lordship shall hear out the matter at his Lordship’s earliest convenience.
The writ appeal is disposed of. As a sequel, the miscellaneous applications, if any, shall stand disposed of as infructuous. In the circumstances, there shall be no order as to costs.
