ORDER:
This revision petition is filed by the petitioner-defendant No.6 challenging the order dated 13.09.2011 passed by the II Additional District Judge, Rangareddy District, at L.B. Nagar, in I.A.No.233 of 2011 in I.A.No.259 of 2010 in A.S.No.46 of 2010.
Originally, the 1st respondent-plaintiff filed suit in O.S.No.191 of 2008 for specific performance of an agreement of sale and the same was decreed. Questioning the same, the petitioner herein filed appeal and also filed an application in I.A.No.259 of 2010 for grant of stay of the decree pending disposal of the appeal. The said application was allowed. While so, the 1st respondent herein filed I.A.No.233 of 2011 before the lower appellate Court seeking to vacate the stay granted in I.A.No.259 of 2010. The said application was allowed vacating the stay granted in I.A.No.259 of 2010. Aggrieved by the same, the petitioner-6th defendant filed this revision.
Heard both sides and perused the material available on record.
Having regard to the facts and circumstances of the case and the submissions made by both the Counsel, this Court feels it just and proper to direct the lower appellate Court to dispose of the appeal, if pending, within a period of three months from the date of receipt of a copy of this order.
With the above direction, the Civil Revision Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, are closed.
