CIVIL REVISION PETITION No.1392 of 2012

ORDER :

Petitioner preferred the present Civil Revision Petition under Article 227 of Constitution of India being aggrieved over the order dated 10.02.2012 passed in I.A.No.2513 of 2011 in O.P.No.400 of 2011 by the Judge, Family Court, Ranga Reddy District at L.B.Nagar. Heard.

Petitioner herein filed the impugned petition under Section 24 of Hindu Marriage Act seeking grant of interim maintenance of Rs.50,000/- per month from the respondent herein and also Rs.10,000/- towards legal expenses, wherein the learned Judge passed the impugned order granting interim maintenance of Rs.10,000/- per month from the date of order till disposal of the main O.P. and also granted Rs.5,000/- towards legal expenses. Aggrieved over the quantum of maintenance, petitioner-wife preferred the present revision.

Since the amount granted in the impugned order is only towards interim maintenance, this Court is not inclined to interfere with the impugned order. However, the Judge, Family Court, Ranga Reddy District, shall dispose of O.P.No.400 of 2011 itself within a period of three months from the date of receipt of a copy of this order. Further, the respondent shall pay the interim maintenance as ordered by the Court below from the date of filing of the impugned application till the disposal of main O.P. and such arrears shall be paid by the respondent to the petitioner herein in three monthly instalments. Subject to above modification, the impugned order is hereby confirmed.

Accordingly the present Civil Revision Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions filed in this revision, if any, shall stand closed.
