The petitioners 1 and 2/A-3 and A-5 along with 9 others are accused of offences punishable under Sections 143, 341, 188 I.P.C in C.C. No.166 of 2012 on the file of I Additional Judicial Magistrate of the First Class, Kadapa. The subject matter is staging of Dharna in front of Vidyut Soudha main gate at Kadapa by supporters of Yuvajana Sramika Rythu Congress party. It is contended by the petitioners’ counsel that basis of the case is promulgation of notification under Section 30 of the Police Act in the district

from 01.10.2011 to 31.10.2011 and that the offence in this case took place on 05.10.2011 and that the information furnished to the petitioners’ counsel under Right to Information Act is to the effect that notification under Section 30 of the Police Act was issued on 30.10.2011 for the month of November from 01.11.2011 to 30.11.2011. The charge sheet speaks about an earlier notification dated 30.09.2011 to the notification dated 30.10.2011 referred to in the information furnished to the petitioners’ counsel under the Right to Information Act. Irrespective of the question relating to the notification under Section 30 of the Police Act, the allegations in the charge sheet attract ingredients for the offences under Sections 143 and 341 I.P.C. Therefore, I do not see any valid reasons to quash the criminal proceedings pending in the lower Court against the petitioners.
