CRIMINAL PETITION NO.3194 OF 2012

ORDER:

Petitioners-accused Nos.1 to 4 filed this Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking to release them on bail pending investigation, enquiry and trial into crime No.24 of 2012 of Soan P.S., Adilabad District, registered for the offences punishable under Sections 363 read with Section 511 and Section 307 read with Section 34 of the Indian Penal Code, 1860 and under section 20 of the Treasury Trove Act.

The allegation is that on 06.03.2012 at about 9 pm, A1, A3 and A4 went to the house of the complainant with an intention to kidnap the son of the complainant, aged about 8 years, who had two circulates on the head and to kill him, so as to get treasury, but for the intervention of neighbours, the accused ran away. In order to get treasury, A2 made puja with turmeric, kum kum and coconuts and A3 and A4 dug the pit with crow bar, but they could not get the treasury. Then A2 told A1, A3 and A4 to bring a child, who had two circulates on the head, so that he can be killed for getting treasury. On his instructions only, A1, A3 and A4 went to the village and tried to kidnap the son of the complainant, aged about 8 years, who had two circulates on the head. But for the timely intervention of the neighbours, the boy was not taken to the temple. If the boy was taken to the temple, there is a possibility of killing him so as to achieve their object.

3. Investigation is pending and A5 and A6 are still absconding. At this stage, there are no grounds to grant bail to the petitioners.

4. Hence, the Criminal Petition is dismissed with liberty to the petitioners to approach this Court after investigation is completed.
