This criminal appeal by the appellant-accused No.2 is directed against the judgment dated 05.04.2006, passed by the
II Additional District Judge, Mahabubnagar, in S.C. No. 99 of 1997, convicting her for the offence under Sections 324 and 302 I.P.C. and sentencing her to suffer imprisonment for life for the offence under Section 302 I.P.C. and further to suffer imprisonment for a period of six months for the offence under Section 324 I.P.C.
Today when the criminal appeal came up for hearing, it is submitted by the learned counsel for the appellant-accused No.2 and the learned Public Prosecutor that the appellant-accused No.2, who is a life convict, was given special remission by the Government of Andhra Pradesh, along with some other life convicts, vide G.O. Ms. No. 28, Home (Prisons C) Department, dated 25.01.2011, on the eve of Republic Day i.e. 26th January, 2011, and was released after taking personal bond. To evidence that the appellant-accused No.2 was given special remission for her release, the learned Public Prosecutor produced copy of the afore-mentioned G.O., which is placed on record.
Since the appellant-accused No.2 was already released from jail upon being given special remission, nothing survives for adjudication in the criminal appeal.
In view of the above, no orders need be passed in the criminal appeal, and the same is accordingly closed.
