Questioning the judgment dated 03.08.2007 passed in S.C. No. 69 of 2006 by the IV Additional Sessions Judge, East Godavari District, Kakinada, acquitting respondents 1 and 2 herein for the offences punishable under Sections 302 read with 34 I.P.C. and 201 I.P.C. and respondent No.2 for the offence punishable under Section 203 I.P.C., the State preferred the present appeal.

Respondents 1 and 2 herein are accused Nos.1 and 2 in the above Sessions Case. The case of the prosecution is that accused Nos.1 and 2 are brothers and they are closely related to the deceased by name Nama Sathibabu. The deceased used to run chit and finance business. In the year 2003, accused No.1 subscribed to a chit run by the deceased for an amount of Rs.8,000/-. After paying three installments of chit subscription amount, he became prized subscriber and received the bid amount. Thereafter, he did not pay the installments of chit subscription amount. The deceased used to demand him to pay the due amount and insult him before his family members, relatives and village elders. Therefore, accused No.1 bore grudge against the deceased. He, in association with accused No.2, planned to do away with the life of the deceased, and both of them waited for an opportunity to execute their plan. In the night of 19.12.2004, the deceased and the accused attended a function at the house of one Nama Manikyam (L.W.10) at Pillanka. In the said function, the deceased questioned accused No.1 about non-payment of the chit amount and insulted him before the relatives. Thereupon, both the accused decided to commit the murder of the deceased. At about 11.00 p.m., accused No.2 requested the deceased to accompany him to attend calls of nature and then both of them proceeded towards southern side canal bund. Accused No.1 followed them with a crowbar and attacked the deceased near the fields of P.W.5, as a result of which the deceased received bleeding injuries. Accused No.1 further kicked the deceased black and blue and then both the accused throttled his neck with a towel and threw his dead body into the canal. They put a stone in the shirt of the deceased to ensure that the dead body of the deceased does not float and thereby cause the evidence regarding the murder of the deceased disappear. On 21.12.2004, at 3.00 p.m., based on the report lodged by P.W.1-Panchayat Secretary, P.W.12-Station House Officer, Coringa Police Station, registered a case in Crime No.160 of 2004 under Section 174 Cr.P.C. P.W.13-Circle Inspector of Police, Kakinada Rural Circle, took up investigation in the case. He visited the scene of offence, prepared rough sketch thereof, seized a ballpoint pen and a fifty paise coin from the scene of offence under cover of observation report and got photographed the moped of the deceased lying there. He then conducted inquest over the dead body of the deceased in the presence of P.W.9, one Angadi Muralikrishna and Penmarthy Venkataswamy (L.Ws.12 and 13), and sent the dead body for post-mortem examination. He arrested the accused on 25.12.2004, and pursuant to their confession, seized the crowbar, bloodstained clothes worn by them and the towel used by them for throttling the neck of the deceased. He then produced the accused before the Court, which remanded them to judicial custody. He sent the material objects seized to RFSL, Visakhapatnam, and altered the Section of law to 302 I.P.C. After receipt of postmortem examination report and after completion of investigation, he filed charge sheet against the accused.

The Sessions Judge framed charges under Sections 302 read with 34 I.P.C. and 201 I.P.C. against accused Nos.1 and 2 and under Section 203 I.P.C. against accused No.2. The accused pleaded not guilty for the said charges and claimed to be tried.

To prove the guilt of the respondents-accused, the prosecution examined P.Ws.1 to 13 and marked Exs.P1 to P15 and M.Os.1 to 9. No oral or documentary evidence was adduced by the accused in defence.

The Sessions Judge, having appreciated the entire evidence available on record, held the respondentsaccused not guilty of the charges framed and accordingly acquitted them for the said charges. Questioning the same, the State preferred the present appeal.

Heard the Additional Public Prosecutor for the State and the counsel for the respondents-accused and perused the judgment under appeal and other material available on record.

The point that arises for consideration in the present appeal is whether the prosecution could establish the guilt of the respondents-accused for the offences punishable under Section 302 read with 34 I.P.C. and Section 201 I.P.C. and also the guilt of respondent No.2-accused No.2 for the offence punishable under Section 203 I.P.C. beyond all reasonable doubt?

P.Ws.1 and 2 are the junior paternal uncles of the deceased. P.W.3 is the father of the deceased. P.Ws.4 to 6 are the independent witnesses. P.Ws.7 and 8 are the relatives of the deceased. P.W.9 is the Panchayat Secretary who lodged Ex.P1 report with the police. P.W.10 is the photographer who took photographs of the dead body of the deceased at the instance of the police. P.W.11 is the doctor who conducted post-mortem examination over the dead body of the deceased. P.W.12 is the Head Constable of Coringa Police Station, who registered the case and issued F.I.R. P.W.13 is the Investigating Officer.

According to the prosecution, both the accused are brothers and closely related to the deceased. The deceased used to run chit business. Accused No.1, having subscribed to a chit, paid three installments of chit subscription amount and thereafter he became prized subscriber and received the bid amount. Thereafter, he did not pay the installments of chit subscription amount, for which the deceased used to insult him in the presence of others and insist him for payment of due amounts. Thereupon, accused No.1 bore grudge against the deceased and decided to kill him and hatched a plan along with accused No.2. On the day of incident, both the accused and the deceased attended a function in the house of one Nama Manikyam (L.W.10) at Pillanka, where the deceased questioned accused No.1 for his not paying the due amount and insulted him before the relatives. Thereupon, both the accused decided to commit the murder of the deceased, and at about 11.00 p.m., accused No.2 took the deceased along with him towards southern side canal bund, to attend calls of nature. Accused No.1 followed them with a crowbar and attacked the deceased near the fields of P.W.5, kicked him black and blue and then both the accused throttled his neck with a towel, resulting in his death, and then threw his dead body into the canal, by putting a stone in his shirt.

To prove that the deceased died a homicidal death, the prosecution examined P.W.11- Professor of Forensic Medicine, Rangaraya Medical College, Kakinada, who conducted autopsy over the dead body of the deceased and issued Ex.P10-post-mortem examination report and Ex.P11-final opinion regarding the cause of the death of the deceased. He stated that on 22.12.2004, on receipt of requisition from the Inspector of Police, Kakinada Rural Circle, he conducted post-mortem examination over the dead body of the deceased and found as many as eight external injuries and four internal injuries, which are ante-mortem in nature, as noted by him in Ex.P10-post-mortem examination report. He opined that the deceased would appear to have died of asphyxia due to ante-mortem throttling (compression of the neck by human hands). He stated that to exclude the role of alcohol and drowning, he preserved the necessary material and sent them to R.F.S.L. Vijayawada. On receipt of report from R.F.S.L. on 21.02.2005, he issued Ex.P11-final opinion regarding the cause of death, on 06.04.2005, to the effect that while under the influence of alcohol, the neck of the deceased was compressed by human hands (throttling) resulting in death due to asphyxia.

Thus, the prosecution could establish that the deceased died a homicidal death. However, to prove that the accused caused the homicidal death of the deceased, the prosecution did not examine any eyewitness to the

incident, and the entire case of the prosecution rests on the circumstantial evidence.

P.W.1 deposed that the deceased is his elder brother’s son and both the accused are the children of his junior paternal uncle. The deceased used to do chit business and also money lending business. On 19.12.2004, a function was held in the house of one Nama Manikyam and in the said function, the deceased asked accused No.1 to pay the chit premium and abused him saying that accused No.1 was having money for drinking but not having money for payment of chit amount. Thereupon, an altercation took place between both of them. At about 11.00 p.m., accused No.2 and the deceased left the function, and after they left, accused No.1 also left. On the next day, in the afternoon, the father of the deceased questioned him as to why the deceased did not return home after attending the function. Then he told him that accused No.2 and the deceased left the function at 11.00 p.m. on the previous night. Then, himself and P.W.2 searched for the deceased. On 21.12.2004, they found the dead body of the deceased floating in Injaram Branch canal. They brought the dead body of the deceased to the bank of the canal and tied it to a stick with a rope. Then they sent word to the father of the deceased and Injaram Panchayat Secretary about their finding the dead body of the deceased. P.W.1 stated that he suspects that the accused might have killed the deceased, as an altercation took place between accused No.1 and the deceased in the function, regarding the payment of chit premium.

In his cross-examination, he denied the suggestion that he deposed for the first time before the Court about the altercation that took place between accused No.1 and the deceased in the function and he did not state about the same before the police. He further categorically stated that prior to 19.12.2004, there were no disputes between accused No.1 and the deceased. He admitted that he stated to the police that the deceased was having illicit intimacy with one Medisetti Dhanalakshmi and in view of the same, the relatives of Dhanalakshmi might have killed the deceased and threw his dead body into the canal.

P.W.2 deposed that the deceased is his elder brother’s son and both the accused are the children of his junior paternal uncle. The deceased used to do chit business and also money lending business. On 19.12.2004, himself, P.W.1 and both the accused attended a function that was held in the house of one Nama Manikyam. In that function, accused No.1 consumed liquor. Thereupon, the deceased told that accused No.1 was not having money to pay the chit premium, but having money to consume liquor. Thereupon, an altercation took place between the deceased and accused No.1. After having dinner, the deceased and accused No.2 left the function, and some time thereafter, accused No.1 also left. On the next day, the father of the deceased questioned him and P.W.1 as to why the deceased did not return home after attending the function on the previous night. They informed him that accused No.2 and the deceased left the function in the midst. Thereafter, himself, P.W.1 and some others searched for the deceased, but in vain. On the next day, they found the dead body of the deceased floating in Injaram Branch canal. Then they removed the body from the canal and tied it to a stick erected on the bund of the canal. Thereafter, they informed the same to the Injaram Panchayat Secretary and the father of the deceased. He stated that they suspected that the accused might have killed the deceased, as there was altercation between accused No.1 and the deceased in the function. They also suspected that the deceased might have been killed by the relatives of one Dhanalakshmi who had illicit intimacy with the deceased. Later, they came to know that the deceased was murdered by the accused.

In his cross-examination, he stated that when the father of the deceased enquired with them about the deceased on the next day of the function, they went to accused No.2 who was available in the village and questioned him about the whereabouts of the deceased, but he pleaded innocence. They did not inform to the police about the disappearance of the deceased on that day after they questioned accused No.2, and did not enquire with any of the villagers of Pillanka village about the deceased. They also did not enquire Medisetti Dhanalakshmi about the deceased. He too denied to have not stated before the police about the altercation that took place between the deceased and accused No.1 with regard to payment of chit premium.

Thus, as can be seen from the evidence of P.Ws.1 and 2, though they denied to have not stated before the police about the altercation that took place between accused No.1 and the deceased, but the fact remains, P.W.13Investigating Officer has categorically stated that they did not state about the same to him. Thus, their version in that regard is an improvement from their statement before P.W.13, and hence cannot be believed. Further, the evidence of P.W.1 shows that he stated to the police that the deceased had illicit intimacy with one Dhanalakshmi and thus her relatives might have killed the deceased. Thus, at first instance, he did not express any doubt as regards the involvement of the accused in the commission of offence. P.W.2 also in his chief-examination stated that they suspected that the relatives of Dhanalakshmi might have killed the deceased, as the deceased had illicit intimacy with her. Thus, his evidence did not pointedly point out to the accused alone to be the person to have had the motive to kill the deceased. Further, the statements of P.W.2 that accused No.1 was consuming liquor in the function and that, after the father of the deceased enquired with them about the deceased, they questioned accused No.2 about the whereabouts of the deceased, are not corroborated by the evidence of P.W.1. Thus, having regard to the inconsistencies and improvements in the evidence of P.Ws.1 and 2, we are of the considered opinion that the prosecution could not establish beyond reasonable doubt, that a quarrel took place between accused No.1 and the deceased with regard to payment of chit amount in the function that was held in the house of one Nama Manikyam, and that led to the accused killing the deceased.

P.W.3 is the father of the deceased and elder brother of accused Nos.1 and 2. He deposed that the deceased used to do chits and money lending business. The accused, having participated in chits, did not pay the premium. Whenever premium is payable by the accused, there used to be an altercation between accused No.1 and the deceased with regard to payment of chit premium. About 2½ years ago, a function was held in the house of Nama Manikyam, and both the accused, the deceased, P.W.1, P.W.2 and other relatives attended the said function. On that night, the deceased did not return home. He learnt that while accused No.1 was consuming liquor in the function, the deceased told him that he was having money for drinking but not having money for payment of chit premium and on that an altercation took place between them. On the next day, he went to P.W.2 and enquired about the deceased and informed that the deceased did not return home after attending the function on the previous night. He also asked accused No.2 about the whereabouts of the deceased and the altercation that took place between accused No.1 and the deceased in the function. Accused No.2 informed him that the deceased and himself together returned back from the function, but he does not know as to where the deceased has gone. Then his relatives, P.W.1 and P.W.2 searched for the deceased, but in vain. On the third day, P.Ws.1 and 2 informed him that they found the dead body of the deceased in Injaram canal and they tied the dead body to a stick on the bund. Then he went to the dead body and identified it to be his son’s dead body. He suspected that both the accused murdered the deceased due to quarrels and due to the altercation that took place in the function at the house of Nama Manikyam.

In his cross-examination, he stated that there is no documentary evidence and that he has not produced any documents before the police to prove that the deceased was doing chits and money lending business. He has also no documentary evidence to show that both the accused joined as members to the chit conducted by the deceased. He further stated that he did not attend the function in the house of Manikyam and that he does not know personally as to what happened in the said function. He also admitted that he stated to the police that the deceased was having illicit intimacy with Medisetti Dhanalakshmi and hence the relatives of said Dhanalakshmi might have killed him.

Thus, in the absence of any documentary evidence to show that the deceased used to do chit business and accused No.1 subscribed to a chit and after becoming prized subscriber and receiving the bid amount, he failed to pay the chit installments, we are of the considered opinion that the testimony of P.W.3, who is the father of the deceased and interested witness, cannot be relied upon to attribute the motive for the accused to kill the deceased,

more particularly, when the evidence of P.Ws.1 to 3 shows that the deceased had illicit intimacy with one Dhanalakshmi, and hence at first instance they suspected that the relatives of said Dhanalakshmi might have killed the deceased.

Further, though P.Ws.1 and 2 have categorically stated that accused No.2 and the deceased together left the function and sometime thereafter accused No.1 also left the function, the fact remains, that itself cannot be a basis to connect the accused with the murder of the deceased, unless the prosecution establishes the other connecting circumstances, which form a chain of events that lead us to draw an inference that the accused alone have committed the offence in all probability.

P.W.4 is an independent witness. He deposed that he knows the deceased and the accused. The deceased used to do money-lending business. About 2½ years ago, when he went to his fields situated near Injaram Branch canal, he found the dead body of the deceased tied to a stick on the bund of Injaram Branch canal. He came to know that somebody beat the deceased and killed him. In his cross-examination, he admitted that he does not know personally that the deceased was doing money-lending business and he learnt it from somebody. His evidence, being hearsay, does not help the prosecution in any way to connect the accused with the commission of the crime.

P.W.5 is also an independent witness. He deposed that on 20.12.2004, when he went to his fields as usual in the morning, he observed bloodstains on the canal bund in his fields. He thought that some animal was killed. On the next day, the villagers of Brahmapuri came to his fields and saw the bloodstains. He told them that he saw the bloodstains on the previous day and also a pen. He identified M.O.1 to be the said pen. He further stated that he learnt from the people of Brahmapuri that there were disputes between the accused and the deceased and that the name of the deceased was Sathibabu and that he was killed by somebody due to business rivalry. In his crossexamination, he admitted that he did not state to the police that there were disputes between the accused and the deceased. Thus, his evidence, which is hearsay in nature, also does not point out to the guilt of the accused.

P.W.6 is another independent witness. He deposed that on 20.12.2004, in the morning, while he was attending to his work in the fields of his master Krishnam Raju, he saw a Hero Majestic Motorcycle by the side of fencing of the field. He identified it to be that of the deceased. He thought that the petrol in the motorcycle might have exhausted or it needed repair, and as such it was kept by the side of fencing. On the next day, he came to know that the dead body of the deceased was found floating in canal water. The people in the village thought that the accused killed the deceased, as there were disputes between them.

Though P.W.6 denied to have not stated to the police that the accused killed the deceased due to the disputes between them, but P.W.13-Investigating Officer has categorically stated that P.W.6 did not state the same before him. At any rate, his evidence that he found the motorcycle of the deceased by the side of the fields of his master, does not help the prosecution to connect the accused with the commission of the offence.

P.W.7 is the relative of the deceased. He deposed that on 19.12.2004, himself, the accused, the deceased, P.W.1 and some others attended the nuptial function of the daughter of one Nama Manikyam. While they were taking dinner, the deceased asked accused No.1 for payment of chit premium. Then, an altercation took place between both the deceased and accused No.1, and they pacified them. After completion of dinner, accused No.2 took the deceased to the canal bund, to attend calls of nature. Thereafter, himself and P.W.1 left the function to go to their houses. While they were going towards a bridge on the way, they heard some cries. When they reached the bridge, they found the Hero Majestic motorcycle of the deceased. They thought that the deceased was attending to calls of nature on the canal bund. After they passed to a little distance, accused No.2 hurriedly went away on the said motorcycle with high speed. Then he went to his house. On the next day, he came to know that the deceased did not return to his house after the function.

In his cross-examination, though he denied to have not stated to the police that there was an altercation between accused No.1 and the deceased in the function and they pacified them, but P.W.13-Investigating Officer has categorically stated that he did not state about the same to him. Further, P.W.7 stated in his cross-examination that even on his coming to know on the next day that the deceased did not return home after the function and even after knowing that the dead body of the deceased was found in canal, he did not inform to P.W.3 or to anybody else about his and P.W.1 hearing the cries near the bridge and their noticing the motorcycle of the deceased on the bridge and accused No.2 going on the same hurriedly. This creates a doubt about the veracity of his evidence. This apart, his evidence that himself and P.W.1 while returning from the function heard some cries near the bridge and found the motorcycle of the deceased on the bridge and that accused No.2 went away hurriedly on the said motorcycle after their passing little distance, is not corroborated by P.W.1. The evidence of P.W.1 does not speak anything about the same. Further, P.W.7 did not corroborate the version of P.Ws.1 and 2 that accused No.1 left the function, some time after the deceased and accused No.2 left the function. Hence, the evidence of P.W.7 cannot be relied upon.

P.W.8 is also a relative of the deceased. He deposed that on 19.12.2004, himself, P.W.7, both the accused and the deceased attended the nuptial function held in the house of one Nama Manikyam. Nama Manikyam and both the accused are members to the chit conducted by the deceased. In the said function, the deceased asked accused No.1 to pay the chit premium, and an altercation took place between them in that regard. After completion of dinner, accused No.2 asked the deceased to come with him to canal bund to attend calls of nature and then both of them left the function. Five minutes thereafter, accused No.1 also left the function. While himself and P.W.7 were returning to their respective houses and when they reached the bridge between Pillanka and Brahmapuri villages, they heard some cries. They also noticed the Hero motorcycle of the deceased on the bridge. After they moved little further, accused No.2 went away on the said motorcycle with high speed. On the next day, he came to know that the whereabouts of the deceased are not known. After he returned from the work in the evening, he came to know that the deceased died and his dead body was found floating in canal. He had seen the dead body of the deceased and police examined him.

In his cross-examination, though he denied the suggestion that he did not hear the cries near the bridge and did not notice the motorcycle on the bridge and accused No.2 going away on the said motorcycle with high speed, but the fact remains, his evidence is not corroborated by P.W.7. According to P.W.7, himself and P.W.1 together left to their houses from the function and they heard some cries near the bridge and found the motorcycle of the deceased, and accused No.2 went away on the said motorcycle after their passing a little distance. Thus, the evidence of P.W.8, which is contrary to and not corroborated by the evidence of P.W.7, also cannot be relied upon.

P.W.9 was the In-charge Panchayat Secretary of Injaram village from March 2004 to 2006. He deposed that on 21.12.2004, P.Ws.1 and 2 came to Panchayat Office and informed him that they found a dead body floating in Injaram canal. Then he went to that place and then reported the matter to Corangi police, under Ex.P1. At about 4.30 p.m., police came to their village and in their presence, they got the dead body removed from the water and placed it on the canal bund with the assistance of village servant. The dead body was clothed with a banian and lungi. He also noticed a heavy injury on the head of the dead body. At that time, one Angadi Muralikrishna and Panchayat Secretary of Brahmapuri village were also present. He further deposed about his drafting Ex.P2observation report, Ex.P3-inquest report, Ex.P4-scene of offence observation report, and Ex.P5-mediators report, under which the police seized blue colour Hero Majestic motorcycle which was found lying by the side of the fencing of the fields of one Raju in Brahmapuri village. He also deposed about the police seizing M.Os.2 to 4- white banian, black and white stripes lungi and waist thread respectively from the dead body of the deceased, at the time of inquest held over of the dead body of the deceased, and M.O.1-pen, M.O.5-bloodstained earth, M.O.6-

half-rupee coin and M.O.7-controlled earth from the scene of offence. He further deposed that on 25.12.2004, on being called by the police, he went to the police station and from there, when himself and the police reached Sunkarapalem junction, they noticed both the accused at that Center. When the police questioned the accused as to their presence at that place and their particulars, they gave evasive replies, and escaped towards Yedurlanka check post. Thereupon, the police chased and caught hold of them, and arrested them in his presence. The accused confessed about the commission of offence by them. Pursuant to recording their confession, the accused led them to the house of Nama Manikyam and produced M.O.8-crowbar that was used by them in the commission of offence. Police seized the same under Ex.P7-seizure panchanama. On the same day at 3.00 p.m., the accused led them to the house of accused No.1, where the police seized M.O.9- bloodstained clothes worn by the accused at the time of commission of offence, under Ex.P8.

In his cross-examination, he admitted that he is not the scribe of Ex.P1 and the panchayat secretary of Govalanka village is its scribe. He stated that except informing that they found a dead body floating in Injaram canal, P.Ws.1 and 2 did not inform him any other particulars. As per Ex.P3-inquest report, the witnesses did not state about the incident that took place in the function held in the house of Manikyam on 19.12.2004. He further stated that M.O.8-crowbar was seized on 21.12.2004. He stated that he cannot identify the Hero Majestic Motorcycle as it was not produced before the Court.

Thus, according to P.W.9, P.Ws.1 and 2 only informed him about their finding a dead body floating in the canal and they did not furnish him any other particulars, and then he went and saw the dead body, and reported the matter to police, and thereafter the police came to the canal and in their presence, they got removed the dead body from the canal with the assistance of village servant. This version of P.W.9 is completely different from the evidence of P.Ws.1 and 2. It is the categorical evidence of P.Ws.1 and 2 that on noticing the dead body of the deceased in the canal, they removed it from the canal and tied it with a rope to a stick erected on the bund of the canal, and then informed P.Ws.3 and 9 about the same. Further, he made inconsistent statements as regards seizure of M.O.8-crowbar used by the accused in the commission of offence, by the police, at the instance of the accused. In his chief-examination, he stated that M.O.8 was seized pursuant to the confession of the accused on 25.12.2004, but in his cross-examination, he stated that it was seized on 21.12.2004. Thus, the prosecution could not establish beyond reasonable doubt that pursuant to their confession to the police on 25.12.2004, the accused produced M.O.8-crobwar used by them in the commission of offence and the police seized the same in the presence of P.W.9.

Further, it is the admission of P.W.9 that he is not the scribe of Ex.P1-complaint and it was scribed by the Panchayat Secretary of Govalanka village. But, the prosecution, for the reasons best known to them, did not examine the said Panchayat Secretary, who is said to have scribed Ex.P1, which is fatal to the case of the prosecution. Further, P.W.13-Investigating Officer admitted that even in Ex.P15-altered F.I.R. and in the report given by the Panchayat Secretary of Tallarevu, there is no mention about the alleged demand of chit premium made by the deceased to the accused and the altercation that took place between the deceased and accused No.1. Though there was nothing incriminating found against the accused at the first instance, and on the other hand it was stated by P.Ws.1 to 3 that there was illegal intimacy between the deceased and one Dhanalakshmi and the relatives of said Dhanalakshmi might have killed the deceased, P.W.13 did not make any investigation about the alleged illegal intimacy between the deceased and Dhanalakshmi, and according to his own admission, he neither mentioned in Part-II Case Diary about the alleged illicit intimacy between the deceased and Dhanalakshmi nor cited the said Dhanalakshmi as a witness. This shows that there are laches on the part of the investigating agency.

For the foregoing discussion, we are of the considered opinion that though the evidence of P.Ws.1, 2, 7 and 8 reveals that accused No.2 and the deceased together left from the function that was held in the house of Nama

Manikyam in the night of 19.12.2004, but the prosecution could not prove beyond all reasonable doubt, the other circumstances connecting the accused with the commission of murder of the deceased, which came to light on 21.12.2004 i.e. one and half days after accused No.2 is alleged to have taken the deceased with him. Further, there is absolutely no evidence on record to prove that accused No.2, having committed the murder of the deceased in association with accused No.1, gave false information to the villagers that due to illicit intimacy between the deceased and Medisetti Dhanalakshmi, either her husband or her relatives might have murdered the deceased. Thus, we hold that the prosecution has utterly failed to establish the charges under Section 302 read with Section 34 I.P.C. and Section 201 I.P.C. against the accused and under Section 203 I.P.C. against accused No.2, beyond all reasonable doubt. Therefore, the judgment passed by the Court below, acquitting the respondents-accused of the said offences, does not call for interference in this appeal.

The criminal appeal is accordingly dismissed.
