CRIMINAL APPEAL No. 1425 of 2004
JUDGMENT:
In spite of opportunity is given, the notice could not be served on the accused. The amount of cheque is said to be Rs.6,850/-. Even in the lower Court also as there was no interest shown to prosecute the case, even though the process is said to have been paid in the lower Court as per the grounds of appeal under ground No.4 on 31.10.2003, the complaint was dismissed on 10.11.2003.
But, as can be seen from the order of the lower Court dated 10.11.2003, it was reported as process is not paid and on the same day the complainant is absence and there was no representation.
The reasons for non-appearance of the complainant and nonreporting of the payment of the process are not convincing and I do not find any reason to interfere with the order of the lower Court.
Accordingly, the Criminal Appeal is dismissed.
