This appeal is directed against the conviction and sentence passed in S.C.No.235 of 2007 by the III Additional Sessions Judge (Fast Track Court), Khammam on 12.09.2007.

The appellant is the sole accused and he was prosecuted for the offence under Sections 498-A and 302 of the Indian Penal Code, 1860 (for

short “IPC”).

According to the prosecution, the deceased Venkataravamma is the wife of the accused and daughter of PW.1. She got married with the accused about four years back. They lived happily for three years and blessed with a male child by name Gopala Krishna and the deceased was carrying four months pregnancy. About one month back the deceased parents performed tonsure function to her son Gopala Krishna at Borragudem. At that time the accused demanded one gold chain for his son, but PW.1 expressed his inability and he gave one gold ring but the accused refused to receive the same and demanded for gold chain. Since then the accused started harassing the deceased both mentally and physically and also ill-treated her. About 10 days back, due to unbearable harassment of accused for gold chain, the deceased went to her parents house and narrated the same to PW.1 and her mother Kanakamma and they convinced her and sent her to the matrimonial house on 14.08.2006 along with PW.2. But the accused insulted both of them by abusing her in filthy language and also made her to stand in front of the house and assaulted and tried to beat them. On 16.08.2006, the deceased and the accused slept with their son in southern side room of their house. On 17.08.2006 at 5.00 hours the accused woke up and planned to do away her with an intention to kill his wife, kept his son outside the room, poured kerosene on her and set fire with match stick, resulting she received burn injuries and she made hue and cry. On hearing the same, her brother-inlaw, PW.3, and neighbours entered into the house and extinguished the flames by pouring water on her later covered with a blanket. The accused informed her in-laws PW.1 and his mother-in-law on phone that the deceased received electric shock injuries. PWs.3 and 6 called the RMP doctor and he examined the deceased and advised them to shift her to the hospital. Then the accused, PW.3 and others shifted her to the Gampalagudem Hospital in an auto and the compounder advised them to shift her to Vijayawada as she sustained severe burn injuries. After admission in Government General Hospital, Vijayawada, the head-

constable PW.9 has visited the hospital and recorded the statement of the deceased and the accused. Meantime, PWs.1 and 2 and other relatives arrived at the GGH, Vijayawada and the deceased narrated the incident to her parents. On the intimation sent by PW.11, PW.14 came to the hospital and recorded her dying declaration on 17.08.2006. The deceased while undergoing treatment died on 20/21.08.2006 at 12.10 a.m. Basing on the complaint given by PW.1, PW.15 registered the case in Cr.No.53 of 2006 under Section 302 of IPC and issued the FIR. Thereafter, PW.16 took up the investigation and he conducted scene of offence panchanama and seized the material objects from the scene of offence and held inquest over the dead body of the deceased and sent the dead body for post mortem examination. He also got the house of the accused inspected by the Additional Assistant Engineer (Electrical) PW.10, who issued the certificate that the electrical equipment are in good condition. After completion of investigation filed the charge sheet against the accused.

The Sessions Judge has framed the charges under Sections 498-A and 302 of IPC against the accused and the accused pleaded not guilty for the said charges.

The prosecution in order to establish the said charges examined P.Ws.1 to 16 and got marked Exs.P-1 to P-21 and MOs.1 to 3. No oral or documentary evidence was adduced in defence but Ex.X-1 was marked on his behalf.

Taking into consideration of said oral and documentary evidence, the Sessions Judge found the accused guilty for the charge under Section 302 of IPC and convicted and sentenced him to suffer imprisonment for life and to pay a fine of Rs.200/- in default to undergo simple imprisonment for two months, he was further convicted for the offence under Section 498-A of IPC and sentenced to undergo rigorous imprisonment for one year and to pay a fine of Rs.100/-, in default to undergo simple imprisonment for one month.

Aggrieved by the said conviction and sentence, the present appeal is filed.

Now the point that arises for consideration is whether the prosecution could able to establish the charges under Sections 498-A and 302 of IPC against the accused beyond reasonable doubt?

POINT:

The appellant’s counsel has pleaded that the prosecution has failed to establish the harassment caused by the accused in connection with any unlawful demand in order to attract the ingredients of Section 498-A of IPC and the dying declaration recorded by PWs.9 and 14 cannot be relied upon as they were brought into existence after tutoring by her parents and the accident register Ex.X-1 and the evidence of PW.4 establishes that the accused himself extinguished the fire and took her to the hospital, as such the accused has no intention to kill his wife and that the conviction under Section 302 and 498-A of IPC are not sustainable.

The Additional Public Prosecutor, on the other hand, has pleaded that from the evidence of PWs.1 and 2, the harassment caused to the deceased in connection with the demand for giving a gold chain to her son at the tonsure function was established and she could not bear the harassment, went to her parents’ house and informed them but they convinced her and sent her to the accused and the accused bore grudge against her and set fire to her by pouring kerosene and the same was established from the dying declaration recorded by PWs.9 and 14 and the subsequent conduct of the accused cannot be a ground to acquit the accused for the offence under Section 302 of IPC.

According to the prosecution, the marriage of the accused and the deceased took place about four years back and they lived happily for three years and out of wedlock she gave birth to a male child, aged about 2 ½ years and at the time of tonsure function the accused demanded the parents of the deceased for giving a gold chain to his son and they expressed their inability and presented a gold ring but the accused refused

the same and since then the accused started harassing the deceased both physically and mentally and she went to her parents’ house and informed the same to her parents but they convinced her and sent her back on 14.08.2006 and on 16.08.2006 night both of them slept in the house and on the next day early morning he set fire to her by pouring kerosene.

PW.1 is the father of the deceased and according to him he performed the marriage of his daughter with the accused about four years prior to the death of his daughter and he paid Rs.70,000/- towards dowry to the accused at the time of marriage and also presented gold ear hangings, gold nose studs and a gold nanthadu. His daughter gave birth to a son and again she was pregnant as on the date of her death. Twenty days prior to the date of death of his daughter, the accused performed tonsure function of his son at Borragudem. At that time, the accused demanded one gold chain for his son but he expressed his inability to present the same. However, he wanted to present a gold ring and he also brought a gold ring but the accused refused to receive the said gold ring. The accused and his daughter together went to their house at Bheemavaram from Borragudem. Four days thereafter he brought his daughter to his house for Raaki pournima and at that time she informed that the accused was abusing and beating her for a gold chain. Three days thereafter his son has dropped his daughter at the house of the accused and returned back to their village on the same day and informed him that the accused abused his wife-deceased and not allowed her into the house for about one hour. On the third day, after return of his son, at about 5.00 a.m. the accused contacted on phone and informed that there were flames when his daughter switched on the electric light and due to those flames she suffered injuries and he advised them to come to the Government Hospital, Vijayawada as they wanted to take the deceased to the said hospital for treatment. Then himself and his wife went to the Government hospital, Vijayawada, and when he questioned about the matter with the deceased, she informed them that in the early morning at about 5.00 a.m. on that day the accused poured kerosene on her while sleeping, set fire to her and

closed the door with a chain from outside. She also informed that on hearing the cries, PW.3, the elder brother of the accused, came and poured water and put off the flames. After death of his daughter, he presented a report in Yerrupalem police station, which is Ex.P-1.

PW.2, who is the brother of the deceased and son of PW.1, has supported the version of PW.1 with regard to the accused demanding for a gold chain at the tonsure function and his father giving a gold ring, which was refused by the accused and he also further stated about taking the deceased to the house of the accused and the accused did not allow his sister to enter into the house for about one hour, as the chain was not presented and also he abused him and his sister and also beat her with stick. Later, he dropped his sister at the house of the accused and returned to his village. Four days thereafter they received an information from the accused stating that his sister suffered injuries due to electric shock and asked them to come to Government hospital, Vijayawada. He also stated about the deceased disclosing them about the accused pouring kerosene and setting fire on her. Thus, from the evidence of PWs.1 and 2, it is established that the accused has demanded for a gold chain for his son at the time of tonsure function and when PW.1 presented a gold ring he refused to receive the same and in that regard, the disputes started between the accused and the deceased and subsequently when PW.2 brought the deceased to his house he abused them and made her to wait outside and beat her with a stick for not bringing the gold chain.

PWs.3 and 6 are the younger brother and uncle of the accused and they have turned hostile to the prosecution and according to them, the deceased sustained bur injuries due to electric shock in the house when she tried to put off the switch. To disprove the said version of PWs.3 and 6, the prosecution has examined PW.10, the Additional Assistant Engineer (Electrical) and he categorically stated about his inspecting the house of the accused at the instance of C.I. of police, Yerrupalem as the accused has alleged in the hospital that the incident has taken place due to electric short circuit and he verified and found them in good condition and

accordingly he issued certificate in Ex.P-15. There is nothing in the crossexamination to disprove the said version of PW.10. The Head Constable, PW.9 while recording the statement of the deceased in the hospital also recorded the statement of the accused, which is marked as Ex.P-13. In the said statement he has stated that the deceased when she switch on, she found burnings in the switch board and she sustained burn injuries all over the body. But by the evidence of PW.10, the said version of the accused that the deceased sustained burn injuries due to electric shock was disproved.

PW.4 is the brother of PW.1, who also came along with him and found the deceased with burn injuries. The doctor, PW.12, who conducted autopsy over the dead body of the deceased, has opined that the deceased sustained 100% burn injuries and the cause of death is due to burns. Thus, the prosecution could able to establish that the deceased died due to burn injuries.

The next point to be considered is whether the accused is responsible for causing the said burn injuries to the deceased.

In order to establish the same, the prosecution has relied upon the evidence of PW.9, the Head-Constable, who recorded the statement of the deceased in the hospital under Ex.P-12 and the Chief Metropolitan Magistrate PW.14, who recorded dying declaration of the deceased on 17.08.2006 at 12.50 p.m. and also the seizure of the material objects from the scene of offence in the presence of PW.8 and the doctor, PW.11, who treated her at the first instance.

PW.11, the Civil Assistant Surgeon, Government General Hospital, Vijayawada stated that the deceased was brought to the hospital representing that she suffered injuries due to electric shock and he gave intimation to the police and Magistrate to record the statement of the victim and the Magistrate came to the hospital at about 1.00 p.m. and recorded the statement of the victim and he was present at the time of recording the

statement and he made an endorsement on the statement recorded by the Magistrate. He further stated that first police recorded the statement of the victim and he was also present at the time of recording the statement by the police but he did not make any endorsement on that statement recorded by the police and in the cross-examination he admitted that in the Accidents Register, it was mentioned that the deceased sustained burn injuries due to electric shock.

PW.9 the Head-Constable, who has recorded the statement of the deceased in the hospital at the first instance has stated that he was incharge of Out-Post on 17.08.2006. He received medical admission intimation about the admission of the deceased and for recording of her statement and he proceeded to the hospital and recorded the statement of the victim, which is marked as Ex.P-12. He also admitted that he also recorded the statement of the accused. In the cross-examination, it is elicited that when he went to the patient on receipt of the intimation, the accused and two or three persons were present with the victim and nobody was present with the victim when he was recording the statement Ex.P-12. He did not obtain certificate of consciousness of the patient from the medical officer.

PW.14 the Chief Metropolitan Magistrate, who has recorded the dying declaration of the deceased, has stated that on 17.08.2006 he received requisition from the Casualty Medical Officer, GGH, Vijayawada for recording of dying declaration of Smt.P.Venkataravamma i.e. the deceased at 12.30 p.m. and immediately he proceeded to the hospital at 12.50 p.m. and got identified the deceased by the doctor and after satisfying that the declarant was conscious, coherent and fit to give statement, he recorded the dying declaration of the declarant, which is marked as Ex.P-20 and he obtained the endorsement of the duty doctor and Ex.P-16 is the requisition received from the hospital, Vijayawada and he also obtained thumb impression of the declarant on Ex.P-20. Thus, as per the statement recorded by PW.9 under Ex.P-12 the deceased has stated to him that on 17.08.2006 in the early morning hours at 5.30 a.m.

while she was sleeping on a cot her husband brought kerosene tin, poured kerosene and set fire to her and due to fear the accused touched her for which he also received burn injuries to the left hand and her husband also told that he has telephoned to her parents. Later she was shifted to Government General Hospital, Vijayawada. In the dying declaration Ex.P20 recorded by PW.14, she has stated that today on the early hours of 5.00a.m. her husband poured kerosene upon her and lit fire to her but she further stated that he burnt her to go to her parents and he extinguished the flames, in that connection he has also received small burning injuries. The people gathered, later brought her to the hospital. In Ex.P-20, the doctor PW.11 has certified about the consciousness of the patient at the time of recording the statement. The statement recorded by PW.9 and the dying declaration recorded by PW.14 are consistent with each other with regard to the accused pouring kerosene and litting fire to the deceased.

As already observed above, the defence taken by the accused as per his statement Ex.P-13 that the deceased sustained burn injuries due to electric shock was disproved by the prosecution. The prosecution by examining PW.8, the Village Secretary, who is the mediator for the scene of offence and his evidence establishes the recovery of MO.1 kerosene tin, MO.2 half burnt rope and MO.3 half burnt broad tape pieces from the scene of offence. Thus, from the above statements given by the deceased, it is established that the accused has poured kerosene and set fire to her and the doctor, PW.12, who conducted post mortem examination, has confirmed that the deceased died due to the burn injuries. Thus, the prosecution has established that the accused is responsible for causing the burn injuries to the deceased due to which she died while undergoing treatment.

The appellant’s counsel has pleaded that from the admission made by PW.2 in the cross-examination and the statements of the deceased recorded by PWs.9 and 14, it is established that the accused himself has brought the deceased to the hospital by extinguishing the fire and,

therefore, the accused has no intention to cause the death of the deceased, as such the conviction under Section 302 of IPC is not sustainable. In support of his contention, he relied upon a decision reported in Babu Sadashiv Jadhav v. State of Maharashtra^[1] . The Division Bench of the Bombay High Court has observed as follows:

“Motive is something, which prompts a man to form an intention and knowledge is an awareness of the consequences of the act. In many cases intention and knowledge merge into each other and mean the same thing more or less and intention can be presumed from knowledge. The demarcating line between knowledge and intention is no doubt thin but it is not difficult to perceive that they connote different things.”

And the Division Bench further observed as under:

“On the evidence in this case, it cannot be said that the accused was so much intoxicated at the time of the incident that he was beside his mind altogether for the time being. He did set his wife on fire, but as soon as her sari started burning he realized the folly of his act and started extinguishing the fire. It shows that he was not so much intoxicated that he was besides his mind altogether. Therefore, the rule that a man is presumed to intend the natural consequences of his act can be applied to him also. At the same time, in order to gather his intention, all the attending circumstances and his preceding and subsequent conduct will have to be taken into consideration. The established circumstances and the subsequent conduct of the accused mentioned above clearly indicate that the accused did not intend to cause the death of his wife, but from his act of pouring kerosene oil and setting her on fire it can be legitimately inferred that he intended to cause the burn injuries to his wife which were likely to cause death. Immediate attempts were made by the accused and the neighbours to extinguish the fire, and the deceased succumbed to the burn injuries about 15 days after the incident. Under such circumstances, the offence committed by the accused is of culpable homicide not amounting to murder punishable under Part I of Section 304 of IPC. Consequently, the conviction of the appellant-accused under Section 302 of IPC will have to be altered to one under S.304(I) IPC.

In the above said decision, the accused set fire to his wife by pouring kerosene and litting fire to her and thereafter he started to extinguish the fire and in the said circumstances the Division Bench of the Bombay High Court has arrived at the conclusion that the accused has no intention to commit the offence of murder but the act of the accused will

amount to culpable homicide not amounting to murder punishable under Section 304 Part-I of IPC. In the present case, as discussed above, the motive for the commission of the offence by the accused is that PW.1 would not fulfill his demand of giving a gold chain to his son at the time of tonsure function and the same was established by the prosecution from the evidence of PWs.1 and 2, but when she returned to the house along with PW.2 on 14.08.2006, the accused abused them and made to stand outside the house for one hour and did not allow into the house and subsequently beat the deceased for not bringing the gold chain and on the night of 16/17.08.2006 he poured kerosene and lit fire to her. But the deceased in her statement Ex.P.12, has stated that after pouring kerosene and litting fire on her body, the accused due to fear touched her and due to which he received burn injuries on his left hand and his leg. In the statement marked as Ex.P-20 recorded by the Magistrate, PW.14, he has mentioned that the accused extinguished the flames and also received small burn injuries and the people gathered there have brought her to the hospital. But PW.2 has admitted in his cross-examination that the accused and his brother have brought his sister to the hospital, Vijayawada in an auto and PW.4, the brother of PW.1 has found the accused in the hospital when he visited the hospital and he also sustained burn injuries on his hands and legs.

The investigating officer, PW.16, has stated that he arrested the accused on 24.08.2006 at his house at Bheemavaram and sent him for judicial custody and requested the Court to send the accused for treatment as he found injuries on his hands. Therefore, it is established that the accused also sustained injuries in the said incident and he shifted the deceased to the hospital for treatment. The question is whether such a conduct can be taken into consideration while deciding the intention of the accused to commit the offence. In the present case, as already discussed above, the accused has taken up a defence that the deceased sustained burn injuries due to electric shock and the same was proved to be false by the prosecution by examining PW.10 and in view of the conduct of the

accused in trying to set up a false plea of the deceased sustaining burn injuries due to the electric shock, merely because he has extinguished the fire and shifted her to the hospital, cannot be said that he has no intention to cause the burns of the deceased. When he has poured kerosene and lit fire to the deceased, he has got knowledge that the said act of the accused would cause death of the deceased. Moreover, the deceased has sustained 100% burn injuries due to the act of the accused. Therefore, in view of the above facts and circumstances of the case, we are not inclined to follow the decision of the Division Bench of the Bombay High Court to hold that the accused has no intention to commit the murder but the act only amounts to culpable homicide not amounting to murder. Thus, the prosecution could able to establish the charges under Sections 498-A and 302 of IPC against the accused beyond reasonable doubt. The trial Court also rightly recorded the findings of the guilt of the accused and the conviction and sentence of the accused for the above said charges does not warrant any interference by this Court in this appeal.

In the result, the Criminal Appeal is dismissed and the conviction and sentence passed in S.C.No.235 of 2007 by the III Additional Sessions Judge (Fast Track Court), Khammam on 12.09.2007, is hereby confirmed.
