stocks available at the Mandal Level Stockist Point and the records maintained therein and they came to the conclusion that, there is a variation of 81 quintals of rice meant for public distribution system. The petitioner has offered an explanation that, the rice was distributed to the various social welfare hostels in the district. The verification carried out by the Vigilance Department revealed that the wardens of the social welfare hostels have disowned the said statement and have asserted that no such stock of rice was received by them. Hence, the petitioner was placed under suspension on 28.01.2009. In the meantime, a DPC was convened for considering the cases for promotion on 08.06.2010. The said DPC has considered the service profile of the individuals and has taken a decision to defer the case of the petitioner. Subsequently, when the petitioner was working at MLS point, Piduguralla, Guntur District, he has indulged in an irregularity of transporting excess rice bags meant for public distribution system to various fair-price shops so that, they can find ultimately their way into open/black market. Hence the petitioner was arrested on 27.12.2010 and was subsequently released, pursuant to an order passed by the High Court granting him bail. Petitioner has filed W.P.No.11622 of 2011 against the orders of placing him under suspension and the said writ petition was dismissed on 25.04.2011. Another DPC was convened on 12.08.2011. But the said DPC has not recommended the name of the writ petitioner for promotion and this fact was asserted in paragraph 10 of the counter affidavit of the Vice-Chairman and Managing Director of the Corporation.
