Contempt Case No.1833 of 2012
Order: (per the Hon’ble the Acting Chief Justice Sri Pinaki Chandra Ghose)
This Contempt Case is filed alleging violation of the order dated 4.9.2012 passed by us in Writ Appeal No. 516 of 2011.
The aforementioned writ appeal was disposed of by us on 4.9.2012 with a direction to the respondent-insurance company to make payment of the brokerage amount to the appellant within a period of two weeks from that date. Alleging that the respondent-insurance company has not complied with the said order, the petitioner filed the present contempt case.
Today, when the matter was taken up for hearing, learned counsel for the respondent-contemnor submitted that an amount of Rs. 28,43,685/- has been paid to the petitioner on 12.11.2012 and a further sum of Rs.6,96,274/is due and payable by the respondent. It is further submitted that balance amount has also been paid to the petitioner today by way of a demand draft of even date for a sum of Rs.6,26,644/- after deducting a sum of Rs. 69,630/towards T.D.S.
In view of that, the order dated 4.9.2012 passed by us in Writ Appeal No. 516 of 2011 has been complied with.
However, it is submitted on behalf of the petitioner that if there is any further amount due leaving the amount already paid, liberty should be given to the petitioner to take steps in accordance with law before the appropriate forum.
While granting such liberty, the contempt case is disposed of.
