The Court made the following: ORDER:
At the interlocutory stage, the writ petition is take up for hearing and disposal of with the consent of the learned counsel for the parties.
This writ petition is filed for a mandamus to declare the inaction of the respondents in restoring the possession of land admeasuring Acs.18.30 guntas in survey No.416 and Acs.13.04 guntas in survey No.417 of Patwargudem, H/o Partilagandi Village, Dammapet Mandal, Khammam District, as arbitrary and contrary to the provisions of the Andhra Pradesh Scheduled Areas Land Transfer Regulation I of 1959. The petitioner sought for a consequential direction to the respondents to restore the land to him.
At the hearing, Sri P.R.K.Amarendra Kumar, learned counsel for the petitioner, submitted that in pursuance of the interim order passed
by this on 01.05.2009 in W.P.M.P.No.12670 of 2009, the respondents have restored the land in question to the petitioner and therefore, the cause in the writ petition does not survive for adjudication.
Having regard to the above statement, the Writ Petition is disposed of as infructuous.
As a sequel to disposal of the writ petition, W.V.M.P.No.1796 of 2010 is disposed of as infructuous.
