ORDER:
This writ petition is filed for a Mandamus to set aside the notice dated 30.11.2010 of the respondent, whereby while issuing showcause notice for withdrawal of cheque power from the petitioner, it was directed that the petitioner shall not draw Gram Panchayat funds either from
the Sub-Treasury or any of the banks.
The petitioner’s grievance chiefly centres around the failure of the respondent in passing a final order on the said show-cause notice to which he is stated to have submitted his explanation on 18.12.2010 (learned counsel for the petitioner stated that the date is wrongly mentioned as 15.12.2010 in the affidavit).
I have heard Sri Bollam Lingaiah Yadav, the learned counsel for the petitioner and the learned Assistant Government Pleader for Panchayat Raj representing the respondent.
Inasmuch as the petitioner’s grievance is innocuous, the respondent is directed to pass a final order, after considering the explanation dated 18.12.2010 stated to have been filed by the petitioner to the show-cause notice dated 30.11.2010, within a period of three weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.
With the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.828 of 2011 filed by the petitioner for interim relief is disposed of as infructuous.
