The petitioners are the owners of different extents of land in Survey Nos.4, 13/E, 8/A, 14/E and 14/W situated at Pothireddypally Village of Sangareddy, Medak District. The Government acquired land to an extent of Acs.99.00 under the Land Acquisition Act, 1894 (the Act, for brevity) in the said Village including the petitioners land for the purpose of housing scheme for general public. An award was passed on 16.01.1987 for Rs.36,000/- per acre. The other owners sought reference under Section 18 of the Act. The references being O.P.Nos.85, 86 and 1098 of 1990 were disposed of by the Court of the District Judge, Medak District, on 29.12.1997 enhancing the compensation to Rs.50/- per square yard. The Government filed appeals before this Court being A.S.Nos.1301 of 1998 and batch. This Court by judgment dated 08.06.2001 modified the lower Court order awarding Rs.75/- per square yard, but directed to deduct 1/3rd of the said amount towards development charges. Aggrieved by the same, the Andhra Pradesh Housing Board – requisition authority filed Civil Appeal before the Supreme Court. In the meanwhile, the petitioners made an application on 23.03.1998 under Section 23(A) of the Act seeking redetermination of the compensation according to the judgment of the trial Court. In response thereto, the respondent informed the petitioners that in view of the pendency of the Special Leave Petitions, though the petitioners are entitled for redertimination of compensation, they shall abide by the terms and conditions of the judgment passed by the Supreme Court. Therefore, the petitioners filed the instant writ petition seeking appropriate declaration and direction.
