ORDER:
This writ petition is filed for the following substantive relief:
“…..to issue any appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in shifting the wine shop M/s.Balaji Wines bearing Gazette No.454 situated at Vijayapuram Village, Chittoor District to Pannur Cross area, Vijayapuram Mandal, Chittoor District against to the Gazette Notification-cum-auction notification issued by the District Collector at the time of making auction of wine shop and at the time of allotment and to declare the action of shifting the above shop Gazette No.454 situated at Vijayapuram Village to other place where Gazette No.457 shop is located as illegal, arbitrary, unconstitutional being violative of Articles 14 and 21 of the Constitution of India and consequently stay of all further proceedings of shifting of shop No.454 situated at Vijayapuram Village namely M/s.Balaji Wines and to pass such other order or orders….”
At the hearing, Sri P.Jagadish Chandra Prasad, learned counsel for the petitioner, seeks permission of the Court to withdraw
the writ petition.
The request of the learned counsel for the petitioner is accepted.
Accordingly, the Writ Petition is dismissed as withdrawn.
As a sequel to dismissal of the writ petition, interim order dated 06.03.2009 as modified on 01.06.2009 in W.P.M.P.No.6337 of 2009 is vacated and W.P.M.P.No.6337 of 2009 and W.V.M.P.No.1753 of 2009 are dismissed as infructuous.
