Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

This writ petition is filed seeking for issuance of writ of mandamus declaring the action of the respondents in not promoting the petitioner to the post of Sub-Overseer (Grade-C) as illegal and arbitrary, and consequently direct the respondents to promote the petitioner as Sub-Overseer (Grade-C) on par with his colleagues duly granting all consequential benefits.

The case of the petitioner is that he was initially appointed as Maistry on 29.04.1977 and, in 1986 he was promoted as Sr.Maistry. The post of Sr.Maistry was subsequently re-designated as Work Inspector and, for the last 25 years, he is working as Work Inspector. It is his case that he passed five Single Civil Engineering subjects and also three Higher Engineering subjects and also possess ITI qualification. As per the Cadre Scheme existing in the 1^st respondent-company, all those employees who passed five subjects in Lower Civil Engineering subjects are entitled for promotion to thepost of Sub-Overseer (Grade-C), and he is the only employee having the said qualification in the 1^st respondent-company, but remained unpromoted despite possessing the requisite qualifications. His further case is that he submitted several representations to the

respondents including the representation dated 05.03.2010 and 15.07.2011 categorically pleading that, he possesses requisite qualification for promotion to the post of Sub-Overseer (Grade-C), but the same has not been considered. Therefore, he filed the present writ petition. Having regard to the facts and circumstances of the case, and as could be seen from the material available on record, the petitioner made representations dated 05.03.2010 and 15.07.2011, wherein he has stated that a person named B. Ramulu, Sr.Maistry, has been promoted from Grade-D to Grade-C as Sub-Overseer after completion of five years service in the year 1991. And, since 1991, the petitioner is making requests to the respondents, but his case has not been considered for promotion.

In view of the above circumstances, the writ petition is disposed of directing the respondents to consider the representations dated 05.03.2010 and 15.07.2011, stated to have been submitted to the Chairman & Managing Director, and to the Director (PA & W) of Singareni Collieries Company Limited, respectively, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
