ORDER:
Petitioners are the residents of Kajuluru Village and Mandal, East Godavari District. In this writ petition, they seek a mandamus declaring the action of the second respondent – Secretary to Government, Panchayat Raj and Rural Development Department, Secretariat, Hyderabad, in granting permission to the fifth respondent – Reliance Communications Limited, Navi Mumbai, India, for erection and installation of cell tower in land admeasuring Ac.0.10 cents, covered by Survey No.613/1 of Kajuluru Village and Mandal, East Godavari District, as illegal and arbitrary.
There is no representation for the petitioners, when the matter is called today. However, learned counsel appearing for the fifth respondent submits that the fifth respondent has decided not to erect any cell tower in the land in question.
In view of the said decision of the fifth respondent, grievance of the petitioners is redressed.
In that view of the matter, placing on record the
submission of the learned counsel appearing for the fifth respondent that the fifth respondent is not erecting any cell tower in the land in question, the writ petition is disposed of. No order as to costs.
