Oral order:

The petitioners claim that they purchased the plots in question and constructed houses therein unauthorizedly, and therefore, they made applications on 14.09.2006, 27.09.2006 and 04.10.2006, in terms of G.O. Ms. No. 616, dated 19.04.2003, seeking regularization of their occupation and unauthorized constructions, it is their case that till date, the respondents have not passed any orders. Hence, they seek appropriate directions.

The respondents filed counter stating that the land in T.S. No. 5/1 is classified as surplus land and, that subsequently, the surplus land in an extent of 8609 Sq.mts., including the land in question, stood exempted in favour of Sri. K.V. Krishna Reddy, vide orders issued by the Government in G.O. Ms. No. 1088, Revenue (U.C. IV) Department, dated 10.08.2007, and in view of the orders issued by the Government in G.O. Ms. No. 508, Revenue (Assgn.I) Department, dated 20.10.1995 and G.O. Ms. No. 1601, Revenue (Assgn.I) Department, dated 29.08.2005, the request of the petitioners for regularization cannot be considered.

However, the learned Government Pleader for Revenue appearing on behalf of the respondents submitted the applications of the petitioners, except petitioner Nos. 2, 6 and 7, were already considered and rejected, and that they will consider and pass appropriate orders on the applications of petitioner Nos. 2, 6 and 7.

In view of the above stand taken by the learned Government Pleader for Revenue, I deem it appropriate to dispose of the writ petition with the following directions:

The respondents are directed to consider the applications of

petitioner Nos. 2, 6 and 7 and pass appropriate orders thereon, in accordance with law, expeditiously.

Accordingly, the writ petition is disposed of. No costs.
