ORDER:
This writ petition has been filed by three individuals seeking a writ of mandamus for declaring the action of the respondents 1 to 4 in seeking to convert the channel poramboke into a road, situated in Sy.Nos.159 and 160 of Ravillavaripalli Revenue Village, Ramachandrapuram Mandal, Chittoor District, for the purpose of conferring a benefit on respondents 5 and 6.
The Tahasildar, Ramachandrapuram Mandal, Chittoor District, filed counter affidavit on behalf of respondents 1 to 3 herein. In para 6 of the said counter affidavit, it is pointed out that the respondents have never tried to change the physical features of the supply channel and that too for the purpose of formation of a road for the benefit of respondents 5 and 6. On the other hand, the counter affidavit proceeded to assert that there are specific directions from the Government to safeguard the water course porambokes and in that view of the matter, the question of converting a spring channel into a road for the benefit of respondents 5 and 6, is neither here nor there.
In view of this assertion of fact, this writ petition deserves to be dismissed and hence, it is, accordingly, dismissed at the stage of admission, but however, without costs.
