ORDER:
The petitioner has filed this Writ Petition aggrieved by the order, dated 02.06.2011, passed by the Assistant Director, Drugs Control Administration, Khammam District, vide which the prayer of the petitioner for cancellation of the Drug Licence of respondent No.5, was rejected.
Learned counsel for the petitioner states that though an appeal is provided under the Drugs & Cosmetics Act 1940, the same has not been preferred by the petitioner.
The petitioner can avail the remedy by filing an appeal before the competent Court. Hence, there are no grounds to allow the Writ Petition and accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
