CIVIL REVISION PETITION No. 4449 OF 2011

O R D E R :

This Civil Revision Petition is preferred by the plaintiffs in O.S(SR) No. 1342 of 2011 on the file of the Agent to Government, Khammam.

The suit was filed seeking an injunction to restrain the defendants and their agents from interfering with the peaceful possession and enjoyment of the suit schedule property by the plaintiffs. The suit schedule property comprises of land of an extent of Ac.1.00 guntas and Ac. 1.30 guntas situate in Survey No. 676 at Papakollu Village of Julurupadu Mandal, Khammam District within the boundaries specified therein. Along with the suit, an interlocutory application is also moved seeking for interim injunction. Complaining that the interim injunction application has not been taken up for consideration so far, this Revision is preferred.

Instead of keeping this Revision pending, it would only be appropriate to direct the learned Agent to the Government at Khammam to consider as to whether a case is made out for grant of interim injunction by the plaintiffs and if so satisfied, would consider and pass appropriate orders thereon, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.

It is needless for me to observe that if the Agent to the Government were to consider it appropriate to put the opposite party on notice, he would do so and accomplish the entire task within a period of six weeks.

With this, the Civil Revision Petition is disposed of. No costs.
