CRIMINAL PETITION No. 5293 of 2011
ORDER:
The petitioner herein is 1st accused in Crime No.37 of 2011, which was registered for the offences under Sections 323, 354, 506 read with Section 34 of Indian Penal Code, 1860.
According to the learned counsel for the petitioner, the offence under Section 354 of Indian Penal Code, 1860 does not apply to the petitioner herein.
Therefore, in view of the above circumstances, the police are directed to proceed with the investigation with regard to the truth of the allegations of other offences. However, the arrest of the petitioneraccused is stayed till filing of the charge sheet.
Accordingly, the Criminal Petition is disposed of.
