ORDER:
Heard the learned counsel appearing for the petitioner, the second respondent and the learned Additional Public Prosecutor representing the State.
This criminal petition is filed seeking to quash the First Information Report in Crime No.149 of 2009 of Narayanaguda Police Station, Hyderabad, registered for the offences under Sections 323, 382, 366 and 506 IPC.
On perusal of the complaint which was forwarded to the police by the Magistrate, basing on which a crime was registered, discloses the material attracting the offences alleged.
The learned counsel appearing for the petitioner would submit that several cases have been filed by the second respondent-wife against the petitioner-husband and this is one of the false cases filed by the wife to harass the husband. This Court earlier passed an order directing the police not to arrest the petitioner and to proceed with the investigation.
Since the matter is under investigation, I am not inclined to quash the First Information Report, however, I direct the police to
complete the investigation at an early date.
Accordingly, the criminal petition is dismissed.
