COMMON ORDER:

These petitions are filed under Section 482 of the Cr.P.C. to quash the investigation proceedings in Crime No.392 of 2010 on the file of the Station House Officer,

II Town Police Station, Visakhapatnam. The complaint is said to have been registered for the offence under Section 498-A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

2. Learned counsel for the petitioners/A-1 to A-3 submits that the complaint is false one and it was filed after the first accused has filed an application for restitution of conjugal rights. Evidently, these facts have to be decided only after completion of investigation by the Police.

3. The contentions raised by the petitioners cannot bar the investigation at the threshold. Therefore, I do not find any reason to quash the proceedings in F.I.R.No.392 of 2010. But however, the first petitioner/A-1 is directed to surrender before the II Additional Metropolitan Magistrate, Visakhapatnam, and on such surrender the accused shall be released on executing personal bond for Rs.5,000/- (Rupees five thousand only) with one surety and shall appear before the II Town Police Station, Visakhapatnam, on every Sunday for a period of one month. In case of arrest of other accused by the Police after completion of investigation they shall be released on bail on their executing personal bond for Rs.5,000/- with one surety each to the satisfaction of the arresting Police.

4. Accordingly, the Criminal Petition is disposed of.
