THE HON’BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No. 12390 of 2011
ORDER:
Petitioners approached this court by invoking the provisions under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.227 of 2011 of Gudur Police Station, Warangal Rural, whereby they are facing charge for the offence punishable under Sections 420 and 379 IPC read with 109 IPC.
2. This court perused the record and heard the arguments. In view of the facts and circumstances of the case, this Court is not inclined to interfere with the investigation at this stage. In any event, as the offence arises out of form house property and also among the partners, the respondent-police are hereby directed to investigate the matter without arresting the petitioners and file final report either way.
3. With the above observation, the Criminal Petition is disposed of. The Miscellaneous Petitions, if any, filed along with this Criminal Petition shall stand closed.
