JUDGMENT :
This is an appeal from the judgment dated 11-05-2004 passed in CC.No. 342 of 2002 by the II-Additional Junior Civil Judge-cum-Judicial Magistrate of First Class, Bapatla, acquitting the respondent-accused for
the offences punishable under section 326 r/w. 34 of IPC.
2. When the matter is listed today, the learned Additional Public
Prosecutor submits that the respondent-accused died. A photostat copy of the death certificate of the respondent-accused is also filed by the learned Additional Public Prosecutor.
3. Perused the photostat copy of the death certificate of the respondent-accused filed by the learned Addl.Publilc Prosecutor. The criminal appeal is, therefore, dismissed as abated.
