ORDER:
This contempt case is filed complaining violation of the orders passed by this Court dated 13.9.2008 in W.P.M.P.No.28502 of 2008 in W.P.No.21856 of 2008.
The order under contempt reads as follows:
“It is the case of the petitioners that the respondents without issuing any notice have cut the coconut trees situated in the land of the petitioners for widening of the road and that they have also not imitated any proceedings under the Land Acquisition Act, 1894. The learned Government Pleader for revenue appearing on behalf of the respondents sought time to get instructions/file counter. Status quo obtaining as on today shall be maintained by the parties.”
It is the case of the petitioners that inspite of the above direction, the respondents are laying down the road on the petition schedule land without initiating any proceedings and paying compensation.
Taking into consideration the developments that had taken place subsequent to the contempt proceedings, this Court directed the respondents to pay compensation to the petitioners to put a quietus to the litigation.
Today, it is represented by the learned Government Pleader that in pursuance of the directions of this Court, the Government granted the compensation and the amount was also disbursed. He also produced a copy of proceedings R.C.No.H1/4900/2008, dated 8.11.2011, a perusal of which shows that the petitioners were paid compensation.
Since the directions of this Court have been complied with, no orders need be passed in this contempt case and the same is accordingly closed. No costs.
