This writ petition is filed seeking a Mandamus declaring the action of the respondents in not filling up the vacant O & M posts i.e., Junior Plant Attendant Posts, while filling up the Engineering Posts i.e., A.E. Posts, as arbitrary, illegal and violative of Articles 14, 16 and 21 of the Constitution of India.

There is no necessity of going into all the details.

Heard the learned counsel for the petitioners and the learned Standing Counsel appearing for the respondents.

The petitioners have no right whatsoever to ask the respondents to fill up the vacancies in Operation & Maintenance (O & M) section of the respondent Corporation, as they cannot dictate the terms to the respondents to fill up the vacancies at a particular point of time, even if the said posts are vacant. Therefore, the relief sought by the petitioners cannot be granted. However, considering the fact that the A.P. Genco, Transco & Discoms Worker’s Union represented by the State General Secretary has also requested the authorities to fill up all the existing vacant posts in the respondent Corporation immediately and submitted a representation dated 07.12.2008 in that regard, I deem it appropriate to dispose of the writ petition as under:

“The respondents are directed to consider the

representation dated 07.12.2008 and pass appropriate

orders as per law within a period of four weeks from the date of receipt of a copy of this order.”

With the above direction, the writ petition is disposed of. No

order as to costs.
