The petitioner, a Paid Secretary in the service of the third respondent Primary Agricultural Co-operative Society (PACS), filed this writ petition aggrieved by the action of the respondents herein in not paying him salary as per the Government Memo No.5661/Coop.III/ 2/91-1, dated 14.10.1991. He sought a consequential direction to pay him salary and other allowances on par with the fifth category employees of DCC Banks with effect from 01.01.1991.
The learned counsel for the third respondent PACS brought it to my notice that a Division Bench of this Court in A.P. STATE CO-OPERATIVE SOCIETIES SECRETARIES AND EMPLOYEES ASSOCIATION V/s. STATE OF ANDHRA PRADESH, FOOD AND AGRICULTURE (DEPT. OF COOP. SOCIETIES) DEPARTMENT[1] held that Paid Secretaries were not entitled to pay scales on par with Category-V Supervisors of DCC Banks and that they could not equate themselves with such employees. In view of the aforestated judgment, the claim of the petitioner to be paid salary on par with the fifth category employees of DCC Banks no longer survives for adjudication.
The writ petition is therefore devoid of merit and is accordingly dismissed. No costs.
