HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT PETITION No.13167 of 2010

ORDER:

Heard Sri Sreenivasa Rao Velivela, Learned Counsel for the petitioner and Sri R.Ramachandra Reddy, Learned Standing Counsel for the Greater Hyderabad Municipal Corporation. At their request, the Writ Petition is being disposed of at the stage of admission.

The petitioner claims to be the owner of 95 sq. yards in Premises No.1-7-803/12, New No.1770, Zamistanpur, Hyderabad having purchased it under a registered sale deed dated 06.08.1998. The petitioner claims to have approached the respondent-Corporation on 02.06.2010 with an application seeking building permission. Her grievance is that the respondents refused to receive her application on the ground that it was not accompanied with T.S.L.R Certificate and No Objection Certificate from the revenue authorities.

In more or less similar circumstances, this Court, in Hyderabad Potteries Private Limited v. Collector, Hyderaba d^[1] and Adge Nagaraju (judgment in WP.No.26366 of 2009 dated 03.12.2009), held that a local authority cannot insist on production of T.S.L.R. or No Objection Certificate from the District Collector.

Following the said judgments, the respondents are directed to receive and process the application of the petitioner for

construction of the building without insisting on production of T.S.L.R. certificate and No Objection Certificate from the District Collector. The respondents shall, however, ensure that the provisions of the Hyderabad Municipal Corporation Act, 1955, the rules and the building bye-laws made thereunder are adhered to while considering the petitioner’s application for grant of building permission.

The Writ Petition is, accordingly, disposed of. However, in the circumstances, without costs.
