WRIT PETITION NO.12989 OF 2010

ORDER:

Heard Sri Sreenivasa Rao Velivela, learned counsel for the petitioner and Sri R.Ramachandra Reddy, learned Standing Counsel for the respondents. At their request, the Writ Petition is being disposed of at the stage of admission.

The petitioner claims to have established KIDS Center at Plot No.66, Avanthi Nagar, Himayat Nagar, Hyderabad, obtaining the premises on lease from the original owner through a registered lease deed dated 02.11.2009. They also stated to have obtained sanitary clearance from the Assistant Medical Officer of Health, Circle No.9, GHMC. It is its grievance that the respondents are interfering with the petitioner’s Center on the specious plea that no license has been obtained. The petitioner would assert that no license is required to establish a KIDS Center, as it is not notified under Schedule “P” of the GHMC Act.

Sri R.Ramachandra Reddy, learned Standing Counsel, would submit that the Writ Petition is filed on mere apprehension and that the Corporation would put the petitioner on notice and given them an opportunity of being heard before any action is taken for violation of the Rules, Regulations and Bye-laws made thereunder.

In view of the submission made by the learned Standing Counsel, the Writ Petition is disposed of directing the respondents not to interfere with the petitioner’s KIDS Center except after putting them on notice and after giving them an opportunity of being heard. The Writ Petition is, accordingly, disposed of. However, in the circumstances, without costs.
