Heard Sri P.Venugopal, learned Senior Counsel appearing for the appellants, learned Assistant Government Pleader for Assignment and at their request the main appeal itself is taken up for disposal.

The only dispute in the appeal is with regard to the representations, which had already been filed by the appellants, were not considered till date.

Brief facts, which are necessary for disposal of the appeal, are as follows:

The appellants-petitioners claim that they are in possession of the land admeasuring Ac.5.00 in Sy.No.21-8 of Krishnamanaidu Kandriga of Yakasiri Revenue Village of Chittamuru Mandal and they sought for assignment of the aforesaid land. They appellants would state that though they made representations dated 14.11.2005, 30.10.2006 and 22.10.2007, they are still pending before the first respondent and are sought to be dispossessed. Against which, the appellants filed W.P.No.329 of 2008. The learned Single Judge while accepting the plea of the petitioners that they are not owning any other land either patta land or assigned land permitted them to file fresh representations within four weeks from that day explaining that the land does not belong to them and they are not in possession, that on filing such an application, the respondents shall consider the same for assignment of any other suitable land, if available, as per the assignment rules and eligibility of the petitioners. this portion of the order, the present Writ Appeal is filed.

Having heard the counsel for both the parties and perusing the material available on record, since the question is narrow that the representations filed by the appellants remained unconsidered by the first respondent, it is wholly unnecessary to go into the details of the case and suffice to hold that the representations filed by the appellants may be disposed of in accordance with law vis-à-vis their entitlement.

Accordingly, the Writ Appeal is allowed only to the extent of directing the first respondent to consider the representations of the appellants dated 14.11.2005, 30.10.2006 and 22.10.2007 and pass appropriate orders thereon. It is needless to mention that if the appellants are in possession, their possession shall not be disturbed till the disposal of the said representations. No order as to costs.
