ORDER:
The de facto complainant – Kamma Siva Rama Krishna and the revision petitioner-accused are present. T h e de facto complainant filed his PAN card bearing No.APBPK 8794D, in proof of his identity. It is reported by the complainant that the matter is settled out of the Court between himself and the accused and he received the amount covered under the cheque. As the offence is under Section 138 of the Negotiable Instruments Act, and in view of the fact that the matter is settled between the parties and the accused has paid the amount covered under the cheque, the petition for compounding the offence is allowed.
2. Accordingly, the Criminal Revision case is allowed and the accused is acquitted under Section 320(8) Cr.P.C.
