Ketha Santhi, Vs Ketha Venkata Ganapathi Rao

This revision is filed by the petitioners challenging the order passed by the learned Magistrate in M.C.No.56 of 2002 on 07.03.2005 wherein the learned Magistrate passed an order directing the first respondent herein to pay a sum of Rs.3,000/- towards maintenance. Petitioners filed the present revision in the year 2005.

Learned Senior Counsel submitted that the petition was filed by the petitioners before the Magistrate Court seeking maintenance of Rs.7,000/-, but without assigning any reasons, the learned Magistrate has ordered only Rs.3,000/-, which is very meagre to maintain the family that too along with two children.

After perusal of the records, this Court without going into merits further, is of the view that since the revision is filed in the year 2005 after lapse of five years, the said amount of Rs.3,000/- granted towards maintenance can be increased to Rs.5,000/-.

Hence, the first respondent herein is directed to pay a sum of Rs.2,500/- to the first petitioner and Rs.1,250/- each to second and third petitioners towards maintenance. Taking into consideration the

lapse of time, the first respondent herein is directed to pay the said sum of Rs.5,000/- from the month of January, 2011.

At this stage, learned Senior Counsel submitted that arrears were also not paid by the first respondent herein. In such a situation, petitioners are at liberty to claim the same before the concern Court. Accordingly, the Criminal Revision Case is disposed of.
