Petition under Section 438 of Crl.P.C praying that in the circumstances stated therewith, the High Court may be pleased to direct the Station House Officer, Subedari Police Station, to release the petitioner on bail in the event of his arrest in connection with C.C.No.63 of 2009 on the file of the IV Additional Judicial Magistrate of First Class, Warangal arising out of Cr.No.378 of 2009 of Subedari Police Station, Warangal.
The Court made the following Order:
“The offence alleged against the petitioner is Section 498 (A) of IPC. There are serious allegations against the petitioner. The contention of the learned counsel for the petitioner is that after he filed a divorce petition against her wife on account of non-cooperation, the present petition is filed. It is reported that
the O.P. for divorce was posted for reconciliation in April, 2010. There might be some possibility of reconciliation between the spouses and in case, the petitioner is arrested that chance would be spoiled.
As such, it is directed that the petitioner shall not be arrested till 26-04-2010 and the matter shall be posted on 26-04-2010 with a report with regard to the result of the conciliation proceedings, under the caption ‘for orders’.”
